AutoCrop is licensed to You (End-User) by Johann Mager, located at business address to be published before launch, Germany ("Licensor"), for use only under the terms of this License Agreement.
By downloading, installing, or using the Licensed Application, You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement. Johann Mager, not Adobe or any app marketplace through which You may have obtained the Licensed Application (the "Services"), is solely responsible for the Licensed Application and its content. The Services are not a party to this License Agreement and have no obligations with regard to the Licensed Application, such as warranty, liability, maintenance, or support.
AutoCrop, when purchased or downloaded, is licensed to You for use only under the terms of this License Agreement. The Licensor reserves all rights not expressly granted to You.
AutoCrop ("Licensed Application") is a piece of software created to automatically detect film borders on scanned analog photos in Adobe Lightroom Classic and crop them, customized for use on desktop computers running Lightroom Classic ("Devices").
The Licensed Application is not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.); if your interactions would be subject to such laws, you may not use the Licensed Application. You may not use the Licensed Application in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
2.1 This license also governs any updates to the Licensed Application provided by Licensor that replace, repair, and/or supplement the original Licensed Application, unless a separate license is provided for such update, in which case the terms of that new license govern.
2.2 You may not share or make the Licensed Application available to third parties (unless permitted by applicable usage rules, and with Johann Mager's prior written consent), sell, rent, lend, lease, or otherwise redistribute the Licensed Application.
2.3 You may not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Licensed Application, or any part of it (except with Johann Mager's prior written consent).
2.4 You may not copy (except where expressly authorized by this license) or alter the Licensed Application. You may create and store backup copies only on devices You own or control. You may not remove any intellectual property notices. If You sell Your Device to a third party, You must remove the Licensed Application from it first.
2.5 Violations of the obligations above, or attempts to do so, may be subject to prosecution and damages.
2.6 Licensor reserves the right to modify the terms and conditions of licensing.
2.7 Nothing in this license restricts applicable third-party terms; when using the Licensed Application, You must comply with them.
3.1 Licensor attempts to keep the Licensed Application updated so it remains compatible with current versions of Lightroom Classic and supported operating systems. You are not granted a right to demand such updates.
3.2 You are responsible for confirming that the device on which You intend to use the Licensed Application meets its technical requirements (see the documentation).
3.3 Licensor reserves the right to modify the technical specifications as appropriate at any time.
4.1 The Licensor is solely responsible for providing any maintenance and support for the Licensed Application. You can reach the Licensor at johann@autocrop.app.
4.2 Johann Mager and the End-User acknowledge that the Services (e.g. Adobe) have no obligation whatsoever to furnish maintenance or support for the Licensed Application.
You acknowledge that the Licensor's use of information related to the Licensed Application and Your use of it is subject to the Privacy Policy. The border-detection engine runs entirely on Your own computer; no photos, previews, or catalog data are transmitted to the Licensor. License activation transmits Your license key (and, if provided, Your email address) to our payment processor's license API to verify Your purchase.
Licensor may periodically collect and use technical data about your device, operating system, and application software to offer product support, facilitate updates, and improve the Licensed Application, in a form that does not personally identify You.
The Licensed Application does not currently offer users the ability to submit or post content. If we provide such a feature in the future, any content or materials You submit ("Contributions") may be treated in accordance with the Privacy Policy. Where applicable, by submitting Contributions You represent and warrant that:
You agree that we may access, store, process, and use information and personal data You provide, following the Privacy Policy and Your choices. By submitting suggestions or feedback, You agree we may use and share it for any purpose without compensation to You. We do not assert ownership over Your Contributions; You retain full ownership and are solely responsible for them.
8.1 Licensor's liability for breach of duty or tort is limited to intent and gross negligence. Only for breach of essential contractual duties (cardinal obligations) is Licensor also liable for slight negligence, and in that case limited to the foreseeable, contractually typical damage. This limitation does not apply to injury to life, limb, or health.
8.2 Licensor takes no responsibility for damages caused by a breach of Your obligations under Section 2. To avoid data loss, You are required to maintain regular backups of Your Lightroom catalog, as with any photographic workflow. You are aware that unauthorized alteration of the Licensed Application may result in loss of access to it.
9.1 Licensor warrants that the Licensed Application is free of spyware, trojan horses, viruses, or other malware at the time of Your download, and that it works as described in the documentation.
9.2 No warranty is provided where the Licensed Application is not executable on Your device, has been modified without authorization, handled improperly, combined with inappropriate hardware or software, or is affected by circumstances outside Johann Mager's control.
9.3 You are required to inspect the Licensed Application promptly after installation and to report any defects to johann@autocrop.app without delay; reports will be considered if received within thirty (30) days of discovery.
9.4 If a defect is confirmed, Johann Mager may choose to remedy it either by fixing the defect or by substitute delivery.
9.5 In the event the Licensed Application fails to conform to an applicable warranty, You may be entitled to a refund of the purchase price in accordance with the Refunds Policy.
9.6 If You are a business (entrepreneur), any claim based on defects expires twelve (12) months after the Licensed Application was made available to You. Statutory limitation periods apply to consumers.
Johann Mager, and not Adobe or any marketplace through which You obtained the Licensed Application, is solely responsible for addressing any claims relating to the Licensed Application, including (i) product liability claims, (ii) claims that the Licensed Application fails to conform to a legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
You represent and warrant that You are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that You are not listed on any US Government list of prohibited or restricted parties.

This license is valid until terminated by Johann Mager or by You. Your rights under this license terminate automatically and without notice if You fail to adhere to any of its terms. Upon termination, You must stop all use of the Licensed Application and destroy all copies, full or partial, of it.
Johann Mager represents and warrants that he will comply with applicable third-party terms of agreement when using services relied on to provide the Licensed Application. Where applicable, subsidiaries of a distribution platform through which You obtained the Licensed Application shall be third-party beneficiaries of this Agreement and, upon Your acceptance, will have the right to enforce it against You as a third-party beneficiary.
Johann Mager and the End-User acknowledge that, in the event of a third-party claim that the Licensed Application or Your possession and use of it infringes that party's intellectual property rights, Johann Mager will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
This License Agreement is governed by the laws of Germany, excluding its conflict-of-law rules. Where You are a consumer habitually resident in the EU, you additionally retain the protection of mandatory provisions of the law of your country of residence.
17.1 If any term of this Agreement is or becomes invalid, the validity of the remaining provisions is unaffected. Invalid terms will be replaced by valid ones that achieve the original purpose as closely as possible.
17.2 Collateral agreements, changes, and amendments are only valid if made in writing. This requirement itself can only be waived in writing.
